我受全國人(ren)大農(nong)業(ye)與農(nong)村委員會委托,就《中華人(ren)民共和國種子(zi)法(修正草案)》的有關(guan)問題(ti)作說明(ming)。
一、為什么修(xiu)改(gai)種子法
種(zhong)(zhong)(zhong)子是發(fa)展現代農(nong)業(ye),保(bao)(bao)障國(guo)家糧食(shi)安(an)全(quan)的(de)(de)基礎。建立激勵(li)和保(bao)(bao)護(hu)原始創新(xin)的(de)(de)種(zhong)(zhong)(zhong)業(ye)法(fa)律(lv)(lv)制度(du),是“打(da)好種(zhong)(zhong)(zhong)業(ye)翻(fan)身仗(zhang)”的(de)(de)關鍵。黨中(zhong)(zhong)央(yang)(yang)、國(guo)務院高度(du)重(zhong)(zhong)視(shi)種(zhong)(zhong)(zhong)業(ye)發(fa)展和知(zhi)識(shi)(shi)產(chan)權保(bao)(bao)護(hu)。習(xi)近平(ping)總書(shu)記指(zhi)出,“創新(xin)是引(yin)領發(fa)展的(de)(de)第一動力,保(bao)(bao)護(hu)知(zhi)識(shi)(shi)產(chan)權就(jiu)是保(bao)(bao)護(hu)創新(xin)。”“要下決心把我國(guo)種(zhong)(zhong)(zhong)業(ye)搞上(shang)去(qu),抓緊培育具有自(zi)(zi)主(zhu)知(zhi)識(shi)(shi)產(chan)權的(de)(de)優良品種(zhong)(zhong)(zhong),從源(yuan)頭上(shang)保(bao)(bao)障國(guo)家糧食(shi)安(an)全(quan)。”“實(shi)現種(zhong)(zhong)(zhong)業(ye)科(ke)技自(zi)(zi)強(qiang)自(zi)(zi)立、種(zhong)(zhong)(zhong)源(yuan)自(zi)(zi)主(zhu)可(ke)控。”2020年(nian)中(zhong)(zhong)央(yang)(yang)經濟工(gong)(gong)作會(hui)議(yi)(yi)(yi)、中(zhong)(zhong)央(yang)(yang)農(nong)村工(gong)(gong)作會(hui)議(yi)(yi)(yi)提(ti)出,要大力推(tui)動自(zi)(zi)主(zhu)創新(xin),保(bao)(bao)護(hu)知(zhi)識(shi)(shi)產(chan)權,打(da)好種(zhong)(zhong)(zhong)業(ye)翻(fan)身仗(zhang)。今年(nian)7月9日,中(zhong)(zhong)央(yang)(yang)全(quan)面深化改(gai)革(ge)委員會(hui)第二十次會(hui)議(yi)(yi)(yi)審議(yi)(yi)(yi)通過《種(zhong)(zhong)(zhong)業(ye)振興(xing)行動方案》,將(jiang)修改(gai)種(zhong)(zhong)(zhong)子法(fa)列為(wei)重(zhong)(zhong)點任務,會(hui)議(yi)(yi)(yi)強(qiang)調,推(tui)進種(zhong)(zhong)(zhong)業(ye)振興(xing),加強(qiang)知(zhi)識(shi)(shi)產(chan)權保(bao)(bao)護(hu),優化營商環(huan)境(jing),要綜合運用(yong)法(fa)律(lv)(lv)、經濟、技術(shu)、行政等(deng)多(duo)種(zhong)(zhong)(zhong)手段,推(tui)行全(quan)鏈條、全(quan)流程監管(guan),對假冒偽劣、套牌侵(qin)權等(deng)突(tu)出問題要重(zhong)(zhong)拳出擊,讓侵(qin)權者付出沉重(zhong)(zhong)代價。
2015年修(xiu)訂的(de)種子(zi)法(fa)(fa),對植(zhi)物(wu)新(xin)品(pin)(pin)(pin)種的(de)授權(quan)(quan)(quan)條(tiao)件、授權(quan)(quan)(quan)原則、品(pin)(pin)(pin)種命名、權(quan)(quan)(quan)利范(fan)圍及例外(wai)、強制許可等作了規范(fan),將(jiang)植(zhi)物(wu)新(xin)品(pin)(pin)(pin)種知識產(chan)權(quan)(quan)(quan)保(bao)(bao)護(hu)(hu)(hu)從行(xing)政法(fa)(fa)規上升(sheng)到法(fa)(fa)律層次,為保(bao)(bao)護(hu)(hu)(hu)育(yu)種者合法(fa)(fa)權(quan)(quan)(quan)益(yi)、促進(jin)種業創新(xin)發(fa)(fa)展提(ti)供了法(fa)(fa)治保(bao)(bao)障。但總(zong)體上看,我國種業知識產(chan)權(quan)(quan)(quan)保(bao)(bao)護(hu)(hu)(hu)還(huan)有短(duan)板(ban)弱項(xiang),國內主要糧食(shi)作物(wu)品(pin)(pin)(pin)種中修(xiu)飾性品(pin)(pin)(pin)種比較多,一些品(pin)(pin)(pin)種繁育(yu)停留在對主要推廣品(pin)(pin)(pin)種和核(he)心親(qin)本的(de)修(xiu)飾改良上,導(dao)(dao)致品(pin)(pin)(pin)種遺傳基礎窄,審(shen)定品(pin)(pin)(pin)種多但突破性品(pin)(pin)(pin)種少,同質化問(wen)題(ti)比較突出,難以適應加強植(zhi)物(wu)新(xin)品(pin)(pin)(pin)種知識產(chan)權(quan)(quan)(quan)保(bao)(bao)護(hu)(hu)(hu)、激(ji)勵育(yu)種原始(shi)創新(xin)、保(bao)(bao)障糧食(shi)安全的(de)新(xin)形勢。因此,亟需對種子(zi)法(fa)(fa)進(jin)行(xing)修(xiu)改,擴大植(zhi)物(wu)新(xin)品(pin)(pin)(pin)種知識產(chan)權(quan)(quan)(quan)權(quan)(quan)(quan)利保(bao)(bao)護(hu)(hu)(hu)范(fan)圍,延伸(shen)保(bao)(bao)護(hu)(hu)(hu)環(huan)節,提(ti)高保(bao)(bao)護(hu)(hu)(hu)水平,加大保(bao)(bao)護(hu)(hu)(hu)力度,用制度導(dao)(dao)向(xiang)激(ji)發(fa)(fa)原始(shi)創新(xin)活力。
從今年3月開始,全國人大農業與農村委(wei)員會牽頭啟動了修改種(zhong)子法(fa)工作,全國人大常委(wei)會法(fa)工委(wei)、農業農村部(bu)(bu)、國家(jia)林業和草原局、司法(fa)部(bu)(bu)、國家(jia)知識產權局等部(bu)(bu)門參(can)與。起(qi)草組深入調查研究,廣泛征求國務院有關部(bu)(bu)門、種(zhong)子企(qi)業及專(zhuan)家(jia)意見(jian),召開評估(gu)論(lun)證(zheng)會,反(fan)復研究,形成了種(zhong)子法(fa)修正草案(an)。
二、修改的主要內容
一是擴大植(zhi)(zhi)物新(xin)品(pin)(pin)種(zhong)(zhong)權(quan)的(de)保(bao)(bao)護(hu)范圍及保(bao)(bao)護(hu)環節。為(wei)(wei)了加強植(zhi)(zhi)物新(xin)品(pin)(pin)種(zhong)(zhong)知(zhi)識產(chan)(chan)權(quan)保(bao)(bao)護(hu),維(wei)護(hu)品(pin)(pin)種(zhong)(zhong)權(quan)人(ren)的(de)合(he)法權(quan)益,借鑒國際通(tong)行(xing)做法,草(cao)案(an)擴大了植(zhi)(zhi)物新(xin)品(pin)(pin)種(zhong)(zhong)權(quan)的(de)保(bao)(bao)護(hu)范圍及保(bao)(bao)護(hu)環節,將保(bao)(bao)護(hu)范圍由授權(quan)品(pin)(pin)種(zhong)(zhong)的(de)繁(fan)(fan)殖材料(liao)延伸(shen)到收獲材料(liao),將保(bao)(bao)護(hu)環節由生產(chan)(chan)、繁(fan)(fan)殖、銷(xiao)售(shou)擴展(zhan)到生產(chan)(chan)、繁(fan)(fan)殖、加工(為(wei)(wei)繁(fan)(fan)殖進行(xing)的(de)種(zhong)(zhong)子處理)、許諾銷(xiao)售(shou)、銷(xiao)售(shou)、進口(kou)(kou)、出口(kou)(kou)、儲存等。草(cao)案(an)體現(xian)權(quan)利一次用盡原則,植(zhi)(zhi)物新(xin)品(pin)(pin)種(zhong)(zhong)權(quan)所有(you)人(ren)對繁(fan)(fan)殖材料(liao)已有(you)合(he)理機會行(xing)使(shi)(shi)其權(quan)利,不再對收獲材料(liao)行(xing)使(shi)(shi)權(quan)利。(第三條)
二(er)是建立(li)實(shi)質性(xing)(xing)派生(sheng)品(pin)(pin)(pin)種(zhong)(zhong)(zhong)制(zhi)度。為(wei)激勵育(yu)種(zhong)(zhong)(zhong)原(yuan)始創新(xin),從源頭上解決種(zhong)(zhong)(zhong)子同質化嚴重問題,草案建立(li)實(shi)質性(xing)(xing)派生(sheng)品(pin)(pin)(pin)種(zhong)(zhong)(zhong)制(zhi)度,明(ming)確實(shi)質性(xing)(xing)派生(sheng)品(pin)(pin)(pin)種(zhong)(zhong)(zhong)可以(yi)申請(qing)(qing)植物新(xin)品(pin)(pin)(pin)種(zhong)(zhong)(zhong)權(quan),并可以(yi)獲得(de)授(shou)權(quan),但對其以(yi)商業(ye)(ye)為(wei)目的(de)利(li)用時,應當(dang)征得(de)原(yuan)始品(pin)(pin)(pin)種(zhong)(zhong)(zhong)的(de)植物新(xin)品(pin)(pin)(pin)種(zhong)(zhong)(zhong)權(quan)所有人的(de)同意(yi)。在(zai)國際植物新(xin)品(pin)(pin)(pin)種(zhong)(zhong)(zhong)保護聯盟77個(ge)成員(yuan)中(zhong),有68個(ge)已經(jing)實(shi)行(xing)這一(yi)制(zhi)度。鑒于(yu)實(shi)施(shi)這一(yi)制(zhi)度是循(xun)序(xu)漸進的(de)過程,草案作出授(shou)權(quan)性(xing)(xing)規(gui)定(ding),實(shi)質性(xing)(xing)派生(sheng)品(pin)(pin)(pin)種(zhong)(zhong)(zhong)實(shi)施(shi)名(ming)錄(lu)(lu)及判(pan)定(ding)指南等,由國務院農業(ye)(ye)農村、林業(ye)(ye)草原(yuan)主(zhu)管部(bu)門依(yi)照本法及有關(guan)(guan)法律確定(ding)。自實(shi)質性(xing)(xing)派生(sheng)品(pin)(pin)(pin)種(zhong)(zhong)(zhong)實(shi)施(shi)名(ming)錄(lu)(lu)發(fa)布(bu)之日起(qi)申請(qing)(qing)的(de)植物新(xin)品(pin)(pin)(pin)種(zhong)(zhong)(zhong),按照實(shi)質性(xing)(xing)派生(sheng)品(pin)(pin)(pin)種(zhong)(zhong)(zhong)相關(guan)(guan)制(zhi)度管理,不溯及既往。(第三條)
三是(shi)完善(shan)侵權(quan)(quan)賠(pei)償(chang)(chang)(chang)制度(du)。為提高(gao)(gao)對侵害植(zhi)物新品(pin)(pin)種權(quan)(quan)行(xing)為的(de)(de)(de)威懾力,加(jia)大了懲罰性(xing)賠(pei)償(chang)(chang)(chang)數(shu)額(e),對權(quan)(quan)利(li)(li)人(ren)(ren)的(de)(de)(de)損失(shi)或(huo)侵權(quan)(quan)人(ren)(ren)獲(huo)得的(de)(de)(de)利(li)(li)益或(huo)品(pin)(pin)種權(quan)(quan)許(xu)可使(shi)用費可以確(que)定(ding)數(shu)額(e)的(de)(de)(de),將賠(pei)償(chang)(chang)(chang)數(shu)額(e)的(de)(de)(de)上限(xian)由三倍提高(gao)(gao)到(dao)五(wu)倍,難(nan)以確(que)定(ding)數(shu)額(e)的(de)(de)(de),將賠(pei)償(chang)(chang)(chang)限(xian)額(e)由三百(bai)萬元提高(gao)(gao)到(dao)五(wu)百(bai)萬元。為保(bao)護種子(zi)市場正(zheng)常交(jiao)易,增加(jia)侵權(quan)(quan)人(ren)(ren)合法來源抗(kang)辯(bian)條款(kuan)。草案規定(ding),不(bu)知道(dao)是(shi)未經植(zhi)物新品(pin)(pin)種權(quan)(quan)所有(you)人(ren)(ren)許(xu)可的(de)(de)(de)授權(quan)(quan)品(pin)(pin)種的(de)(de)(de)繁(fan)殖(zhi)材(cai)料或(huo)者收獲(huo)材(cai)料,能證明該繁(fan)殖(zhi)材(cai)料或(huo)者收獲(huo)材(cai)料具有(you)合法來源的(de)(de)(de),不(bu)承(cheng)擔賠(pei)償(chang)(chang)(chang)責任。(第八條)
四是完善(shan)法(fa)律(lv)責任。為強化對種(zhong)(zhong)(zhong)子(zi)生產(chan)(chan)特別是果樹(shu)種(zhong)(zhong)(zhong)苗(miao)(miao)生產(chan)(chan)檢驗、檢疫(yi)的(de)管理,防止攜帶疫(yi)病果樹(shu)種(zhong)(zhong)(zhong)苗(miao)(miao)流(liu)入(ru)市場,草案(an)明(ming)確(que)(que),不(bu)具有(you)繁殖種(zhong)(zhong)(zhong)子(zi)的(de)隔離和(he)培育條件,不(bu)具有(you)無檢疫(yi)性有(you)害(hai)生物(wu)的(de)種(zhong)(zhong)(zhong)子(zi)生產(chan)(chan)地(di)點或(huo)者縣級以上人民(min)政府(fu)林業草原(yuan)主管部門確(que)(que)定(ding)的(de)采種(zhong)(zhong)(zhong)林從事種(zhong)(zhong)(zhong)子(zi)生產(chan)(chan),未執行種(zhong)(zhong)(zhong)子(zi)檢驗、檢疫(yi)規程生產(chan)(chan)種(zhong)(zhong)(zhong)子(zi)的(de),追究法(fa)律(lv)責任。(第九條)
今年4月26日(ri),全(quan)國(guo)人大常委會(hui)(hui)第二十(shi)八次會(hui)(hui)議審議了國(guo)務院提(ti)出(chu)(chu)的《〈中(zhong)華人民共(gong)和國(guo)道路交(jiao)通安(an)全(quan)法(fa)(fa)〉等(deng)9部(bu)法(fa)(fa)律(lv)的修正(zheng)案(草(cao)案)》,其中(zhong)種(zhong)子法(fa)(fa)修改主(zhu)要針對“放管(guan)服”改革,對林木種(zhong)子有(you)關行政(zheng)許可事項作(zuo)出(chu)(chu)調(diao)整。經與憲法(fa)(fa)和法(fa)(fa)律(lv)委員(yuan)(yuan)會(hui)(hui)研究,將上述修正(zheng)案涉及種(zhong)子法(fa)(fa)的內容(rong)與農業與農村委員(yuan)(yuan)會(hui)(hui)提(ti)出(chu)(chu)的修正(zheng)草(cao)案合并,提(ti)交(jiao)全(quan)國(guo)人大常委會(hui)(hui)繼續審議。
此外,草案(an)還(huan)對有關條(tiao)款作了文字修改(gai)。
