為(wei)進一步理(li)清食品(pin)安全(quan)監(jian)管責任,建立健(jian)全(quan)協同監(jian)管機制,強化全(quan)鏈條監(jian)管合力,堅決守牢食品(pin)安全(quan)底線(xian),切實保障人民群眾身體健(jian)康和生命安全(quan),經黨(dang)中央、國務院同意,現提出如下意見。
一、完善(shan)食(shi)用農產品協同監管
(一(yi))嚴格落(luo)實(shi)食用農(nong)(nong)(nong)產(chan)(chan)(chan)品(pin)質(zhi)(zhi)量(liang)(liang)(liang)(liang)安全(quan)(quan)(quan)監(jian)(jian)(jian)管(guan)(guan)職責(ze)。生(sheng)態(tai)環境(jing)部門(men)負責(ze)推進農(nong)(nong)(nong)用地(di)土(tu)壤重金(jin)屬(shu)污(wu)染溯源(yuan)和整治。農(nong)(nong)(nong)業(ye)農(nong)(nong)(nong)村部門(men)負責(ze)履行(xing)食用農(nong)(nong)(nong)產(chan)(chan)(chan)品(pin)從(cong)種植養殖到進入(ru)批發、零(ling)(ling)售(shou)市(shi)場(chang)或(huo)生(sheng)產(chan)(chan)(chan)加工(gong)企業(ye)前的(de)質(zhi)(zhi)量(liang)(liang)(liang)(liang)安全(quan)(quan)(quan)監(jian)(jian)(jian)管(guan)(guan)職責(ze);市(shi)場(chang)監(jian)(jian)(jian)管(guan)(guan)部門(men)負責(ze)履行(xing)食用農(nong)(nong)(nong)產(chan)(chan)(chan)品(pin)進入(ru)批發、零(ling)(ling)售(shou)市(shi)場(chang)或(huo)生(sheng)產(chan)(chan)(chan)加工(gong)企業(ye)后(hou)的(de)質(zhi)(zhi)量(liang)(liang)(liang)(liang)安全(quan)(quan)(quan)監(jian)(jian)(jian)管(guan)(guan)職責(ze)。縣級以上地(di)方(fang)政府要認真落(luo)實(shi)食用農(nong)(nong)(nong)產(chan)(chan)(chan)品(pin)質(zhi)(zhi)量(liang)(liang)(liang)(liang)安全(quan)(quan)(quan)屬(shu)地(di)管(guan)(guan)理責(ze)任,加強監(jian)(jian)(jian)管(guan)(guan)能力建設,研(yan)究(jiu)解決本級食用農(nong)(nong)(nong)產(chan)(chan)(chan)品(pin)質(zhi)(zhi)量(liang)(liang)(liang)(liang)安全(quan)(quan)(quan)監(jian)(jian)(jian)管(guan)(guan)中(zhong)的(de)職能交叉和監(jian)(jian)(jian)管(guan)(guan)空白問(wen)題,避(bi)免(mian)出(chu)現(xian)監(jian)(jian)(jian)管(guan)(guan)漏(lou)洞和盲區。鄉(xiang)鎮(zhen)政府要落(luo)實(shi)食用農(nong)(nong)(nong)產(chan)(chan)(chan)品(pin)質(zhi)(zhi)量(liang)(liang)(liang)(liang)安全(quan)(quan)(quan)監(jian)(jian)(jian)管(guan)(guan)責(ze)任。
(二(er))加強(qiang)(qiang)食用農(nong)(nong)產(chan)(chan)品(pin)(pin)產(chan)(chan)地(di)準出與市(shi)場(chang)準入(ru)銜接(jie)。農(nong)(nong)業(ye)農(nong)(nong)村(cun)部(bu)門和(he)(he)(he)市(shi)場(chang)監(jian)(jian)管部(bu)門要(yao)(yao)加強(qiang)(qiang)協調配(pei)合(he),切實發(fa)揮承諾達標(biao)(biao)合(he)格證(zheng)在食用農(nong)(nong)產(chan)(chan)品(pin)(pin)產(chan)(chan)地(di)準出與市(shi)場(chang)準入(ru)中的(de)銜接(jie)作用。農(nong)(nong)業(ye)農(nong)(nong)村(cun)部(bu)門要(yao)(yao)做好承諾達標(biao)(biao)合(he)格證(zheng)開(kai)具(ju)、使(shi)用相關工(gong)作的(de)指(zhi)導服務和(he)(he)(he)監(jian)(jian)督(du)檢(jian)查(cha),對未(wei)按規定開(kai)具(ju)承諾達標(biao)(biao)合(he)格證(zheng)的(de)依(yi)法予以查(cha)處(chu),加強(qiang)(qiang)食用農(nong)(nong)產(chan)(chan)品(pin)(pin)上市(shi)前禁(jin)(jin)限(xian)(xian)用藥(yao)物和(he)(he)(he)易超標(biao)(biao)常規藥(yao)物殘(can)留速(su)測把關。市(shi)場(chang)監(jian)(jian)管部(bu)門要(yao)(yao)督(du)促食品(pin)(pin)生產(chan)(chan)經營者(zhe)強(qiang)(qiang)化進(jin)貨查(cha)驗(yan),指(zhi)導食用農(nong)(nong)產(chan)(chan)品(pin)(pin)批發(fa)市(shi)場(chang)依(yi)法開(kai)展入(ru)場(chang)查(cha)驗(yan)和(he)(he)(he)抽樣檢(jian)驗(yan),加大禁(jin)(jin)限(xian)(xian)用藥(yao)物和(he)(he)(he)易超標(biao)(biao)常規藥(yao)物殘(can)留速(su)測力度(du)。鼓勵(li)食品(pin)(pin)生產(chan)(chan)經營者(zhe)優先采購附具(ju)承諾達標(biao)(biao)合(he)格證(zheng)的(de)食用農(nong)(nong)產(chan)(chan)品(pin)(pin)。建立承諾達標(biao)(biao)合(he)格證(zheng)問題(ti)通報(bao)協查(cha)機制,完善不合(he)格產(chan)(chan)品(pin)(pin)閉環處(chu)置(zhi)流程。
(三)強化(hua)(hua)肉(rou)(rou)類(lei)產(chan)(chan)品(pin)(pin)檢(jian)(jian)驗(yan)(yan)檢(jian)(jian)疫(yi)(yi)出證查(cha)驗(yan)(yan)。農(nong)業農(nong)村(cun)部門要(yao)強化(hua)(hua)肉(rou)(rou)類(lei)產(chan)(chan)品(pin)(pin)檢(jian)(jian)驗(yan)(yan)檢(jian)(jian)疫(yi)(yi)出證管理,建立完善(shan)屠宰檢(jian)(jian)疫(yi)(yi)出證信(xin)息(xi)化(hua)(hua)系(xi)統(tong),推(tui)進(jin)(jin)肉(rou)(rou)類(lei)產(chan)(chan)品(pin)(pin)品(pin)(pin)質檢(jian)(jian)驗(yan)(yan)無紙化(hua)(hua)出證,明確檢(jian)(jian)驗(yan)(yan)檢(jian)(jian)疫(yi)(yi)證明公(gong)開查(cha)驗(yan)(yan)途徑。完善(shan)禁止對牲(sheng)畜(chu)、禽類(lei)注水或(huo)注入其他物質的(de)相關規定。市場監管部門要(yao)督促食品(pin)(pin)生產(chan)(chan)經(jing)營者將肉(rou)(rou)類(lei)產(chan)(chan)品(pin)(pin)檢(jian)(jian)驗(yan)(yan)檢(jian)(jian)疫(yi)(yi)合格證明作(zuo)為肉(rou)(rou)類(lei)產(chan)(chan)品(pin)(pin)進(jin)(jin)貨查(cha)驗(yan)(yan)的(de)基礎憑證;積極(ji)探索應用(yong)信(xin)息(xi)化(hua)(hua)手段,加強與農(nong)業農(nong)村(cun)部門的(de)信(xin)息(xi)共享和互(hu)(hu)聯互(hu)(hu)通。
(四)加快建立食(shi)(shi)用農(nong)(nong)產(chan)品(pin)質(zhi)(zhi)(zhi)量(liang)安(an)全追(zhui)溯(su)協作(zuo)和執(zhi)法合作(zuo)機(ji)制。農(nong)(nong)業農(nong)(nong)村(cun)部(bu)要(yao)會(hui)同市場(chang)監(jian)管(guan)總局等(deng)部(bu)門制定食(shi)(shi)用農(nong)(nong)產(chan)品(pin)質(zhi)(zhi)(zhi)量(liang)安(an)全追(zhui)溯(su)管(guan)理(li)辦法,建立健全食(shi)(shi)用農(nong)(nong)產(chan)品(pin)質(zhi)(zhi)(zhi)量(liang)安(an)全追(zhui)溯(su)目錄(lu)。農(nong)(nong)業農(nong)(nong)村(cun)、市場(chang)監(jian)管(guan)部(bu)門要(yao)建立食(shi)(shi)用農(nong)(nong)產(chan)品(pin)質(zhi)(zhi)(zhi)量(liang)安(an)全監(jian)管(guan)信息共(gong)享及反饋(kui)機(ji)制,加強食(shi)(shi)用農(nong)(nong)產(chan)品(pin)質(zhi)(zhi)(zhi)量(liang)安(an)全風險防范(fan),強化輿情監(jian)測和應急處置協調聯動;密切食(shi)(shi)用農(nong)(nong)產(chan)品(pin)質(zhi)(zhi)(zhi)量(liang)安(an)全行政執(zhi)法協調協作(zuo),對突出問題(ti)進行專項治理(li)整頓。
二、強化(hua)食(shi)品生(sheng)產經營許(xu)可審查
(五)規(gui)范食品(pin)生產經營市(shi)場(chang)(chang)準入。食品(pin)生產經營許(xu)可(ke)(ke)部門應(ying)嚴(yan)(yan)格落實許(xu)可(ke)(ke)審查(cha)要求,嚴(yan)(yan)禁擅(shan)自改變許(xu)可(ke)(ke)條件或(huo)未經審查(cha)即(ji)予(yu)許(xu)可(ke)(ke),省級以上(shang)市(shi)場(chang)(chang)監(jian)管部門要對食品(pin)生產經營許(xu)可(ke)(ke)實施情況進行督導檢查(cha)。地方政府指定(ding)市(shi)場(chang)(chang)監(jian)管部門以外的部門實施許(xu)可(ke)(ke)的,應(ying)符合法律授權規(gui)定(ding),明(ming)確(que)申請受理(li)、材料審查(cha)、現(xian)場(chang)(chang)核查(cha)、許(xu)可(ke)(ke)決定(ding)責(ze)任(ren)分(fen)工,完善許(xu)可(ke)(ke)和(he)監(jian)管工作銜(xian)接機制(zhi)。加強傳統特色食品(pin)加工制(zhi)作工藝保護,與現(xian)代(dai)檢測(ce)技術有(you)機銜(xian)接,確(que)保食品(pin)特色和(he)質量(liang)安全。
(六)完善特(te)殊食(shi)品(pin)注冊許可(ke)制度(du)。省級以(yi)上市場監管部門依職(zhi)責嚴格開(kai)展特(te)殊食(shi)品(pin)注冊、備案(an)、生產許可(ke)審(shen)(shen)(shen)查,對(dui)符合(he)條件的重點品(pin)種實施(shi)優先審(shen)(shen)(shen)評審(shen)(shen)(shen)批。市場監管總局(ju)和國家(jia)衛生健(jian)(jian)康(kang)委要加強(qiang)協作(zuo)(zuo),開(kai)展特(te)殊食(shi)品(pin)技術聯(lian)動、專家(jia)聯(lian)審(shen)(shen)(shen);統籌完善食(shi)品(pin)健(jian)(jian)康(kang)聲稱和保健(jian)(jian)食(shi)品(pin)功能聲稱相關工作(zuo)(zuo)。
(七(qi))完(wan)善食品安(an)全(quan)檢(jian)查(cha)員制度。市場(chang)監管(guan)部門要加強(qiang)食品安(an)全(quan)檢(jian)查(cha)履職(zhi)能力建設(she),進一步完(wan)善食品安(an)全(quan)檢(jian)查(cha)員制度,做好許可審查(cha)、監督檢(jian)查(cha)、注冊核(he)查(cha)等專業檢(jian)查(cha)工(gong)作。強(qiang)化培訓考(kao)核(he)和統一調配使用,提升(sheng)專業檢(jian)查(cha)能力和水平。
三、加快建立食品貯存監管機制
(八)加強食(shi)品(pin)貯(zhu)存(cun)(cun)安全監(jian)管(guan)。農(nong)業農(nong)村、海關、市場(chang)監(jian)管(guan)、糧食(shi)和儲備(bei)等部門(men)依職責建立(li)健全食(shi)品(pin)貯(zhu)存(cun)(cun)監(jian)管(guan)制度,明確監(jian)管(guan)要求(qiu)。加強對從事食(shi)用農(nong)產(chan)品(pin)、食(shi)品(pin)、食(shi)品(pin)添加劑及食(shi)品(pin)原料等貯(zhu)存(cun)(cun)主體的監(jian)督檢(jian)查,規范(fan)貯(zhu)存(cun)(cun)經(jing)營行為。
(九)落實(shi)食品(pin)(pin)貯(zhu)存(cun)(cun)主體(ti)責(ze)任。食品(pin)(pin)貯(zhu)存(cun)(cun)主體(ti)應建立完善食品(pin)(pin)安(an)全(quan)(quan)管理制度,保證必備的食品(pin)(pin)貯(zhu)存(cun)(cun)條(tiao)件,實(shi)施食品(pin)(pin)貯(zhu)存(cun)(cun)全(quan)(quan)過程記錄,嚴(yan)格風險管控。食品(pin)(pin)貯(zhu)存(cun)(cun)委(wei)(wei)托(tuo)方(fang)應對(dui)受托(tuo)方(fang)的食品(pin)(pin)安(an)全(quan)(quan)保障能力進行審核,并(bing)監督受托(tuo)方(fang)按照保證食品(pin)(pin)安(an)全(quan)(quan)的要(yao)求(qiu)進行貯(zhu)存(cun)(cun)。食品(pin)(pin)貯(zhu)存(cun)(cun)委(wei)(wei)托(tuo)方(fang)和(he)受托(tuo)方(fang)應當明(ming)確入庫(ku)出庫(ku)交付查驗要(yao)求(qiu),嚴(yan)格交付銜接和(he)入庫(ku)出庫(ku)管理。
(十)強化食(shi)品(pin)(pin)貯存(cun)(cun)屬地管(guan)理(li)(li)責(ze)任(ren)。縣級以(yi)上地方政府應明(ming)確食(shi)品(pin)(pin)貯存(cun)(cun)的(de)部(bu)門監管(guan)和(he)行業(ye)管(guan)理(li)(li)責(ze)任(ren),督促屬地食(shi)品(pin)(pin)貯存(cun)(cun)主體落實食(shi)品(pin)(pin)安全責(ze)任(ren)。非食(shi)品(pin)(pin)生產(chan)經營者從事(shi)對溫度、濕度等有特殊要求食(shi)品(pin)(pin)貯存(cun)(cun)業(ye)務的(de),應納入食(shi)品(pin)(pin)安全監管(guan)范圍。
四、加快建立(li)食品運輸協同監管機(ji)制
(十(shi)一(yi))建(jian)立(li)(li)實(shi)施(shi)散(san)裝液(ye)態(tai)食(shi)品(pin)運輸(shu)(shu)準(zhun)運制度。依(yi)法建(jian)立(li)(li)散(san)裝液(ye)態(tai)食(shi)品(pin)運輸(shu)(shu)準(zhun)運制度,明確運輸(shu)(shu)散(san)裝液(ye)態(tai)食(shi)品(pin)車輛的食(shi)品(pin)安全準(zhun)入條件和技術標(biao)準(zhun),核發食(shi)品(pin)準(zhun)運證明,確保專車專用。制定實(shi)行運輸(shu)(shu)準(zhun)運制度的散(san)裝液(ye)態(tai)食(shi)品(pin)重點(dian)品(pin)種(zhong)目錄。
(十(shi)二)加(jia)強食(shi)(shi)品運(yun)(yun)(yun)輸(shu)全過(guo)程(cheng)監(jian)(jian)管(guan)(guan)。市場監(jian)(jian)管(guan)(guan)部門要會同交通運(yun)(yun)(yun)輸(shu)、農業(ye)農村、糧食(shi)(shi)和儲備等部門建立健全對食(shi)(shi)品和食(shi)(shi)用農產品運(yun)(yun)(yun)輸(shu)發貨(huo)方、承運(yun)(yun)(yun)方、收貨(huo)方的協同監(jian)(jian)管(guan)(guan)機制(zhi),研究(jiu)制(zhi)定運(yun)(yun)(yun)輸(shu)電子(zi)聯單管(guan)(guan)理要求,加(jia)強交付、裝卸、運(yun)(yun)(yun)輸(shu)管(guan)(guan)理和運(yun)(yun)(yun)輸(shu)工具日常管(guan)(guan)理,強化從業(ye)人員教育培訓(xun),壓實(shi)各方食(shi)(shi)品安全主體責任,防范污染變質(zhi)風險。
五、健全食品寄(ji)遞安全和配送(song)安全管理
(十三)強化食(shi)品(pin)寄(ji)(ji)遞(di)(di)安(an)(an)全(quan)管(guan)理。郵政(zheng)管(guan)理部門要督(du)促郵政(zheng)企(qi)業、快遞(di)(di)企(qi)業落實實名(ming)收(shou)(shou)寄(ji)(ji)、收(shou)(shou)寄(ji)(ji)驗視(shi)、過機安(an)(an)檢制度,防范利用寄(ji)(ji)遞(di)(di)渠(qu)(qu)道(dao)(dao)寄(ji)(ji)遞(di)(di)假冒(mao)偽劣食(shi)品(pin)。郵政(zheng)管(guan)理部門要與市場監管(guan)等部門加強協作(zuo),加大對寄(ji)(ji)遞(di)(di)環(huan)節涉食(shi)品(pin)安(an)(an)全(quan)違法線索的(de)核查處置力(li)度,依法打(da)擊利用寄(ji)(ji)遞(di)(di)渠(qu)(qu)道(dao)(dao)銷售假冒(mao)偽劣食(shi)品(pin)的(de)違法行為。
(十四)加強(qiang)(qiang)網絡訂(ding)餐(can)(can)配送(song)安(an)全管理。市(shi)場(chang)監管部(bu)門要督促網絡訂(ding)餐(can)(can)平臺、餐(can)(can)飲經營者(zhe)履行食(shi)品安(an)全法(fa)律(lv)法(fa)規規定的(de)(de)義務,落實網絡訂(ding)餐(can)(can)配送(song)環節食(shi)品安(an)全責任。人力資源社會保障部(bu)門要將掌握食(shi)品安(an)全法(fa)律(lv)知識(shi)納入網約配送(song)員國(guo)家職(zhi)業技(ji)能標準。網絡訂(ding)餐(can)(can)平臺、餐(can)(can)飲經營者(zhe)應根(gen)據(ju)國(guo)家職(zhi)業技(ji)能標準,結合實際(ji)建(jian)立適合網絡訂(ding)餐(can)(can)配送(song)行業勞動者(zhe)的(de)(de)培訓(xun)模(mo)式,強(qiang)(qiang)化食(shi)品安(an)全法(fa)律(lv)知識(shi)培訓(xun)。
六、加強網絡食品銷售新業態監管
(十五)壓實網(wang)(wang)絡(luo)食(shi)品(pin)(pin)(pin)(pin)(pin)銷售從(cong)業主體責任。網(wang)(wang)絡(luo)交易平臺(tai)企(qi)業要按規(gui)(gui)定(ding)設(she)置專(zhuan)門的(de)食(shi)品(pin)(pin)(pin)(pin)(pin)安全管(guan)理機(ji)構(gou)或指定(ding)專(zhuan)職食(shi)品(pin)(pin)(pin)(pin)(pin)安全管(guan)理人員;嚴格審查(cha)(cha)食(shi)品(pin)(pin)(pin)(pin)(pin)生產(chan)(chan)經(jing)營(ying)(ying)者(zhe)入網(wang)(wang)銷售主體資質(zhi),規(gui)(gui)范主體信(xin)息(xi)、食(shi)品(pin)(pin)(pin)(pin)(pin)信(xin)息(xi)刊載公示(shi),依法(fa)對食(shi)用農(nong)產(chan)(chan)品(pin)(pin)(pin)(pin)(pin)承諾達標合格證展(zhan)(zhan)示(shi)、藥物殘留檢(jian)測等(deng)(deng)進行檢(jian)查(cha)(cha)把關;加強入網(wang)(wang)銷售行為(wei)過程管(guan)控,及時(shi)發(fa)(fa)現違(wei)規(gui)(gui)行為(wei)并作出相(xiang)應(ying)處置。主播(bo)及其(qi)服務機(ji)構(gou)要規(gui)(gui)范開展(zhan)(zhan)營(ying)(ying)銷活動,依法(fa)對其(qi)推薦的(de)食(shi)品(pin)(pin)(pin)(pin)(pin)進行查(cha)(cha)驗。廣告(gao)活動參與者(zhe)要依法(fa)開展(zhan)(zhan)食(shi)品(pin)(pin)(pin)(pin)(pin)類互聯網(wang)(wang)廣告(gao)設(she)計、制作、代理、發(fa)(fa)布等(deng)(deng)。食(shi)品(pin)(pin)(pin)(pin)(pin)生產(chan)(chan)經(jing)營(ying)(ying)者(zhe)要嚴把質(zhi)量安全關,保(bao)持線上線下同(tong)標同(tong)質(zhi)。從(cong)業主體明知或應(ying)知產(chan)(chan)品(pin)(pin)(pin)(pin)(pin)違(wei)法(fa)但未采取相(xiang)關處置措施的(de),依法(fa)承擔相(xiang)應(ying)責任。
(十六(liu))強化(hua)網(wang)(wang)絡(luo)銷(xiao)售(shou)食(shi)品(pin)安全問(wen)題(ti)(ti)協同(tong)治(zhi)理。市場監管(guan)部(bu)(bu)(bu)門要會(hui)同(tong)農業(ye)農村、工業(ye)和(he)(he)信(xin)息化(hua)、網(wang)(wang)信(xin)、廣電等部(bu)(bu)(bu)門明確直播帶貨(huo)、私域(yu)電商、社區團購等網(wang)(wang)絡(luo)食(shi)品(pin)銷(xiao)售(shou)新業(ye)態治(zhi)理要求,依(yi)職責加強網(wang)(wang)絡(luo)銷(xiao)售(shou)食(shi)品(pin)安全問(wen)題(ti)(ti)信(xin)息監測(ce)通(tong)報和(he)(he)協查處(chu)(chu)置(zhi)。網(wang)(wang)信(xin)部(bu)(bu)(bu)門對各部(bu)(bu)(bu)門通(tong)報的網(wang)(wang)絡(luo)銷(xiao)售(shou)食(shi)品(pin)安全方面的不實虛假信(xin)息配合(he)做好相應處(chu)(chu)置(zhi)工作。強化(hua)行(xing)政處(chu)(chu)罰和(he)(he)刑事(shi)處(chu)(chu)罰雙向銜接,依(yi)法打擊違法犯(fan)罪行(xing)為。
七、健(jian)全餐(can)飲服務綜合監管機制(zhi)
(十(shi)七)加強網(wang)(wang)絡訂(ding)餐線(xian)上線(xian)下(xia)一體化監管。市場監管部門要會同(tong)工業(ye)和(he)(he)信息化、網(wang)(wang)信等部門對存在食品安全(quan)嚴(yan)重違法情(qing)形的平臺(tai)依法處置。推動平臺(tai)和(he)(he)商戶實行(xing)“互(hu)聯網(wang)(wang)+明廚亮灶”,強化無堂食外賣監管和(he)(he)社(she)會監督。
(十八)強(qiang)化集(ji)中(zhong)用(yong)餐(can)單位食品(pin)安(an)全協同管(guan)理。教(jiao)育、民政(zheng)、衛生(sheng)健康等(deng)部(bu)門要(yao)強(qiang)化對本行(xing)業(ye)集(ji)中(zhong)用(yong)餐(can)單位的(de)食品(pin)安(an)全教(jiao)育和日常管(guan)理。市場監管(guan)部(bu)門要(yao)強(qiang)化集(ji)中(zhong)用(yong)餐(can)單位食品(pin)安(an)全監督檢(jian)查及抽檢(jian)監測(ce),依法(fa)查處(chu)違法(fa)行(xing)為并通報(bao)同級行(xing)業(ye)主管(guan)部(bu)門。
(十(shi)九)完善(shan)校(xiao)園食(shi)品安(an)全協同管(guan)(guan)(guan)理機制。教(jiao)育(yu)部(bu)門(men)(men)要(yao)會(hui)(hui)同農業(ye)農村(cun)、市(shi)場監(jian)(jian)管(guan)(guan)(guan)部(bu)門(men)(men)建立健全學(xue)校(xiao)食(shi)堂(tang)(tang)食(shi)品安(an)全全過程管(guan)(guan)(guan)理制度。教(jiao)育(yu)部(bu)門(men)(men)要(yao)加(jia)強對(dui)學(xue)校(xiao)食(shi)品安(an)全相關工作的(de)統籌(chou)管(guan)(guan)(guan)理和指導,完善(shan)學(xue)校(xiao)食(shi)堂(tang)(tang)大宗食(shi)材供(gong)(gong)(gong)應商資質評(ping)審(shen)制度,建立供(gong)(gong)(gong)應商不良記錄(lu)清單(dan),推(tui)動優質安(an)全食(shi)材進(jin)入學(xue)校(xiao)食(shi)堂(tang)(tang)。推(tui)動學(xue)校(xiao)食(shi)堂(tang)(tang)大宗食(shi)材集中(zhong)招標(biao)采(cai)購,建立采(cai)購數字化(hua)平臺,規范食(shi)材采(cai)購、供(gong)(gong)(gong)應、驗收(shou)、結算等流程。教(jiao)育(yu)部(bu)門(men)(men)要(yao)指導中(zhong)小學(xue)校(xiao)園膳食(shi)監(jian)(jian)督家(jia)長(chang)委員會(hui)(hui)高效規范運行,會(hui)(hui)同市(shi)場監(jian)(jian)管(guan)(guan)(guan)等部(bu)門(men)(men)及時辦理反(fan)饋或直送的(de)問題(ti)。市(shi)場監(jian)(jian)管(guan)(guan)(guan)部(bu)門(men)(men)要(yao)嚴格承(cheng)包經(jing)(jing)營、食(shi)材供(gong)(gong)(gong)應、供(gong)(gong)(gong)餐等經(jing)(jing)營主體準入許可,依法查處涉及學(xue)校(xiao)食(shi)品安(an)全違(wei)法行為。
八(ba)、完善進口食品風險聯防聯控(kong)機制
(二十)強化進口(kou)食(shi)品(pin)部(bu)(bu)(bu)門(men)監(jian)(jian)管(guan)(guan)聯動。境外發(fa)生(sheng)的(de)(de)(de)(de)食(shi)品(pin)安全事件(jian)可能(neng)對我國境內(nei)(nei)造成影(ying)響,或(huo)者(zhe)在進口(kou)食(shi)品(pin)中發(fa)現嚴(yan)重食(shi)品(pin)安全問題的(de)(de)(de)(de),海關應當(dang)及(ji)時(shi)采(cai)取(qu)風(feng)險預(yu)警或(huo)者(zhe)控(kong)制措(cuo)施,并向同級市場(chang)監(jian)(jian)管(guan)(guan)、衛生(sheng)健康、農(nong)業(ye)農(nong)村部(bu)(bu)(bu)門(men)通報(bao),接(jie)到(dao)通報(bao)的(de)(de)(de)(de)部(bu)(bu)(bu)門(men)應當(dang)及(ji)時(shi)采(cai)取(qu)相應措(cuo)施,并向海關反饋。市場(chang)監(jian)(jian)管(guan)(guan)部(bu)(bu)(bu)門(men)發(fa)現國內(nei)(nei)市場(chang)上銷售的(de)(de)(de)(de)進口(kou)食(shi)品(pin)存在嚴(yan)重食(shi)品(pin)安全問題,或(huo)者(zhe)在生(sheng)產加(jia)工(gong)環(huan)節(jie)發(fa)現企業(ye)將進口(kou)的(de)(de)(de)(de)非食(shi)品(pin)原(yuan)料用(yong)于食(shi)品(pin)生(sheng)產加(jia)工(gong)的(de)(de)(de)(de),應當(dang)及(ji)時(shi)采(cai)取(qu)風(feng)險防(fang)控(kong)措(cuo)施,依(yi)法依(yi)規(gui)處置(zhi)并向同級海關通報(bao);海關對市場(chang)監(jian)(jian)管(guan)(guan)部(bu)(bu)(bu)門(men)通報(bao)的(de)(de)(de)(de)問題,應及(ji)時(shi)開展風(feng)險評估(gu),并根據評估(gu)情況依(yi)法依(yi)規(gui)處置(zhi)。有關部(bu)(bu)(bu)門(men)應依(yi)職責加(jia)強對綜(zong)合保稅區等海關特殊監(jian)(jian)管(guan)(guan)區域(yu)內(nei)(nei)食(shi)品(pin)生(sheng)產經營的(de)(de)(de)(de)安全監(jian)(jian)管(guan)(guan)。
(二十一)完(wan)善(shan)跨(kua)境電(dian)(dian)商(shang)(shang)零售進(jin)口(kou)食(shi)品(pin)監管(guan)(guan)(guan)制(zhi)度。商(shang)(shang)務(wu)部(bu)要會同海關(guan)總署、市(shi)場監管(guan)(guan)(guan)總局(ju)建立跨(kua)境電(dian)(dian)商(shang)(shang)零售進(jin)口(kou)食(shi)品(pin)負面清單,將明令暫停進(jin)口(kou)的(de)疫區食(shi)品(pin)以及(ji)(ji)因出現重大質量安全風險啟動(dong)應(ying)急處置的(de)食(shi)品(pin)等(deng)列入負面清單并實(shi)時(shi)調整。海關(guan)要根據市(shi)場監管(guan)(guan)(guan)部(bu)門(men)需要,按規定(ding)提供跨(kua)境電(dian)(dian)商(shang)(shang)企業、平(ping)臺及(ji)(ji)境內服務(wu)商(shang)(shang)等(deng)相關(guan)信息,及(ji)(ji)時(shi)開展食(shi)品(pin)安全風險信息交流。市(shi)場監管(guan)(guan)(guan)總局(ju)、商(shang)(shang)務(wu)部(bu)等(deng)部(bu)門(men)要進(jin)一步明確跨(kua)境電(dian)(dian)商(shang)(shang)零售進(jin)口(kou)食(shi)品(pin)召回責(ze)任。市(shi)場監管(guan)(guan)(guan)部(bu)門(men)要加大召回監管(guan)(guan)(guan)力(li)度,督促相關(guan)責(ze)任方及(ji)(ji)時(shi)召回。
九、加強組織實施
各(ge)地區(qu)各(ge)有關(guan)部(bu)(bu)門要(yao)高(gao)度重視食(shi)品(pin)安(an)(an)全(quan)工(gong)作,在黨中央集中統一領(ling)導(dao)下,強化組織領(ling)導(dao),結合實(shi)(shi)(shi)際抓好(hao)本意(yi)見貫徹落實(shi)(shi)(shi)。國(guo)務(wu)院食(shi)品(pin)安(an)(an)全(quan)委員會及其辦公室要(yao)充(chong)分發揮統籌協調(diao)指導(dao)作用,整合優化食(shi)品(pin)安(an)(an)全(quan)領(ling)域技(ji)術(shu)資源,提高(gao)支撐(cheng)保(bao)(bao)障能力。各(ge)有關(guan)部(bu)(bu)門要(yao)各(ge)負其責(ze)、有效協同(tong),確保(bao)(bao)食(shi)品(pin)安(an)(an)全(quan)全(quan)鏈條、各(ge)環節監管有機銜接,責(ze)任全(quan)面落實(shi)(shi)(shi)。重大事項及時按程序向黨中央、國(guo)務(wu)院請(qing)示報告。
